This triggered Article 50 of the Treaty on the European Union, which defines the procedure for the withdrawal of an EU member state, thus opening a two-year countdown to withdrawal. Differences remain over the future access of European fishing fleets to British waters and state aid. If the EP approves the agreement by a simple majority, it will have to be adopted by the EU by the overqualified majority of the European Council of the remaining 27 Member States (20 from the other EU-27 representing 65% of the EU-27 population). The withdrawal agreement negotiated between the EU and the UK and concluded on 14 November 2018 will be discussed in detail in this briefing. It was approved by the heads of state and government of EU Member States at an extraordinary European Council on 25 November, and the British Prime Minister did so in the British Parliament and across the country. The agreement has been the subject of in-depth discussions in Parliament on several occasions and has been adopted three times. But the House of Commons did not accept it. A second extension of Article 50 lasted until 31 October 2019, but once again the UK faces the possibility of leaving the EU without a deal if the agreement or any other agreement is not ratified by the UK and the EU. On the European Union side, the European Parliament also approved the ratification of the agreement on 29 January 2020 and the Council of the European Union approved the conclusion of the agreement by e-mail on 30 January 2020.  That is why, on 30 January 2020, the European Union also tabled its instrument for ratification of the agreement, concluding the agreement and allowing it to enter into force on the date of the UK`s withdrawal from the EU on 31 January 2020, at 11 .m GMT. Some EU rules on food and agriculture also apply to NI during the backstop period.
Existing controls on animals and animal products moving from the UK to NI need to be strengthened. The political statement states that provisions to address health and plant protection barriers to trade barriers should be introduced “on the basis of WTO agreements and going beyond.” On the issue of the Irish border, there is a protocol on Northern Ireland (the “backstop”) which is attached to the agreement and establishes a position of withdrawal which will only come into force in the absence of effective alternative provisions before the expiry of the transition period. In this case, the UK will eclipse the EU`s common external tariff and Northern Ireland will stick to aspects of the internal market until such an event is carried out. Neither party can unilaterally withdraw from this customs union. The aim of this backstop agreement is to avoid a “hard” border in Ireland, where customs controls are needed.  They will have to resort to World Trade Organization rules if no agreement is reached, which means new tariffs, border controls and other trade barriers. The British Parliament approved the draft agreement by adopting on 23 January 2020 the implementing laws (the 2020 Withdrawal Agreement Act) of the European Union (withdrawal agreement). Following the signing of the agreement, the UK Government adopted and tabled the UK`s ratification instrument on 29 January 2020.  The agreement was ratified by the Council of the European Union on 30 January 2020, after approval by the European Parliament on 29 January 2020. The UK`s withdrawal from the EU came into force on 31 January 2020 at 11 .m GMT, when the withdrawal agreement came into force in accordance with Article 185. The withdrawal agreement provides for a transitional period until 31 December 2020, during which time the UK will remain in the internal market, to ensure the smooth flow of trade until a long-term relationship is concluded.
